The purpose of this document is to set out the General Terms and Conditions governing the online accommodation booking services provided by Duques de Bergara, S.L.U. (hereinafter “Catalonia Hotels & Resorts”), a Spanish company with its registered office at c/ Bergara number 11, 08002 Barcelona, telephone number 932360000, with tax identification number B58227877 and registered in the Barcelona Commercial Register, volume 7569, book 6875, section 2, page 89,678.

The terms “you” and “user” are used here to refer to all individuals who, for whatever reason, access www.cataloniahotels.com (hereinafter, the website) or use the services provided on the portal. Use of these services implies full and unreserved acceptance of, and agreement to be bound by, each and every one of these General Terms and Conditions. As a customer, you declare that you are of legal age and have sufficient legal capacity to be bound by these General Terms and Conditions when entering into a contract with Catalonia Hotels & Resorts.

Catalonia Hotels & Resorts hereby informs you that the procedures for obtaining the services offered are those described in these General Terms and Conditions, as well as any other specific procedures indicated on screen whilst browsing, and you hereby declare that you are aware of and accept these procedures as necessary for contracting the services offered on the website.

Right of admission and cancellation of the booking

Catalonia Hotels & Resorts and, where applicable, the relevant hotel reserve the right to refuse admission to their premises, in accordance with the applicable regulations. In particular, access to or continued stay at the establishment may be refused to users who: (i) fail to comply with the Hotel’s internal rules prior to arrival or during their stay, (ii) engage in behaviour that is detrimental to the peaceful coexistence, safety or hygiene of the establishment, (iii) make improper use of the facilities or services. In such cases, the Hotel may, where appropriate, cancel the booked stay without entitlement to a refund, unless otherwise provided for by applicable regulations.

Furthermore, Catalonia Hotels & Resorts reserves the right to cancel the booking in the event of: (i) a supervening inability to provide the service for reasons beyond its control; (ii) the discovery of material errors in the booking; (iii) fraudulent use of payment methods; or (iv) breach by the guest of these terms and conditions.

Where the cancellation is attributable to Catalonia Hotels & Resorts or the Hotel, any amounts paid will be refunded. Where the cancellation is due to fraud, non-payment or a breach attributable to the user, the terms and conditions of the agreed rate shall apply and, where applicable, the Catalonia Rewards Terms and Conditions.

The purpose of the online accommodation booking services is to book a room and associated services at any of the hotels in the Catalonia Hotels & Resorts chain. Use of these services implies full and unreserved acceptance of, and agreement to, each and every one of these general terms and conditions, as well as the specific terms and conditions agreed for the stay selected by the user. The features associated with the Catalonia Rewards programme, including the redemption of Travel Cash via the Website, may not be available for all hotels, rates, products or services. In such cases, the terms and features enabled at any given time by Catalonia Rewards shall apply, and the redemption may be carried out directly at the hotel where this option is available.

After making an online booking, the user will receive a confirmation email containing their booking reference number. This email serves as proof of their booking and as confirmation of their acceptance of the general and specific terms and conditions.

Furthermore, the user may receive an email enabling them, if they so wish, to complete an online pre-check-in, thereby streamlining the check-in process at the hotel upon arrival.

The user undertakes to use the services in accordance with the law, morality, public decency and public order, as well as with the provisions of these General Terms and Conditions. Consequently, the user is obliged not to use the services for unlawful purposes and/or in contravention of these General Terms and Conditions, in a manner that infringes the rights and/or interests of third parties, or which, in any way, may harm the services, Catalonia Hotels & Resorts and/or its reputation.

Catalonia Hotels & Resorts may, for greater flexibility and for the benefit of users, unilaterally modify at any time and without prior notice the online accommodation booking services provided or the operational, technical and usage conditions of such services.

Where Travel Cash or any other benefit associated with the Catalonia Rewards programme is used, the programme’s Terms and Conditions of Participation in force at any given time shall also apply.

The online accommodation booking form will contain the details or specific terms and conditions of the stay booked by the user: hotel, checkin and checkout dates, meal plan, policy on extra beds, cancellation policy, amongst others.

When carrying out a search, prices will be shown per room per night; however, the total price of the booked stay, together with details of VAT, any other applicable indirect tax or tourist tax, will be shown in each case on the relevant booking form.

Bookings made via this website will be guaranteed by the credit card details provided by the user on the form. Failure to perform the checkin on the day of arrival (“no-show”) or cancellation at short notice (less than 24 hours’ notice) will result in the automatic charging of the credit card for the amount corresponding to one night’s stay, as well as the cancellation of the booking.

To cancel a booking, you may contact us from Monday to Friday between 8.30 am and 8.00 pm, and on Saturdays and Sundays from 10.00 am to 2.00 pm and from 4.00 pm to 8.00 by calling our booking centre on 932360059. Outside these hours, please contact the hotel directly.

Catalonia Hotels & Resorts reserves the right to amend, unilaterally and without prior notice, any of the provisions set out in these General Terms and Conditions, as it sees fit.

Furthermore, in the event of an error in the publication of the price, Catalonia Hotels & Resorts reserves the right to amend the booking price and shall be exempt from any liability arising from such an amendment, provided that the incorrect price was published as a result of a technical and/or human error and provided that the error is verified by the customer.

If any provision of these General Terms and Conditions is declared null and void or inoperative, the remaining provisions shall remain in force as agreed. No provision in this contract shall in any way affect the mandatory provisions relating to consumers. If you are not a consumer, you expressly waive your right of withdrawal.

These General Terms and Conditions are governed by Spanish law and any disputes arising therefrom shall be settled before the courts of the city of Barcelona, Spain, which shall have exclusive jurisdiction to the exclusion of any other jurisdiction. This shall be without prejudice to the jurisdiction of the courts and tribunals of the consumer’s place of residence in the event that the user qualifies as a consumer and user as provided for in Law 1/2007, which approves the consolidated text of the General Law for the Protection of Consumers and Users, as well as any supplementary laws or current legislation that may replace it from time to time.
