LEGAL BASIS FOR PARTICIPATION IN THE PROMOTION

1.- COMPANY ORGANIZING THE PROMOTION

The company Duques de Bergara S.L.U. (hereinafter, Catalonia Hotels & Resorts) with registered address at Bergara 11, 08002 Barcelona and identification number B-58227877 organizes for promotional purposes the sweepstakes (hereinafter, "the Promotion") of international scope, to be carried out through the Internet, for users residing worldwide and over 18 years of age in accordance with the provisions set forth in the section on conditions for participation.

2.-STARTING DATE AND ENDING DATE

The Promotion will begin on March 1, 2023 and will end on May 21, 2023.

3.- PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION

The participation requirements will be the following:

To be over 18 years of age or to have the prior written consent of the legal representative (parent or guardian) in the case of a minor, who will accept the terms and conditions of the promotion and will receive the prize on his/her behalf if he/she is the winner. If the minor is the winner, he/she will not be able to enjoy the accommodation on his/her own or with persons other than his/her legal representatives, unless they authorize it and provide the hotel with the corresponding written and signed authorization.
To have registered upon payment of 6€ to participate in the virtual race / Europe Catalonia 5k 2023 on the website https://catalonia-5k.40challenge.events/login.
The mechanics of the promotion is that Catalonia Hotels & Resorts will draw through a web page of random numbers the three winners. The winner will be notified by email and will be asked to confirm his/her registration to the race in order to verify compliance with the conditions of the Promotion.

Participation in the Promotion implies acceptance of these legal bases.

4.- CONDITIONS OF THE PROMOTION AND PRIZE

There will be three winners who will win a stay for two people in a Catalonia hotel in Spain, according to availability. The prize does not include transportation or transfers. The prize must be enjoyed between June 15, 2023 and June 15, 2024.

The three winners will be notified by email on June 10, 2023 to the winners and on June 15, 2023 to all sweepstakes participants. If the winner does not meet the participation requirements, another winner will be chosen to obtain a new winner.

5.- LIMITATIONS

If it becomes evident that any of the participants do not meet the requirements set forth in the Rules, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prize awarded by virtue of this Promotion.

The prize awarded will not be transferable or subject to changes, alterations or compensation at the request of the participants, and cannot be exchanged for any other product or money.

The winner will be responsible for any fiscal or tax charge that the acceptance of the prize may entail, as well as any other expense derived from the promotion that is not expressly assumed by Catalonia Hotels & Resorts in these Rules.

6.- PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory or which could infringe the rights of third parties will not be allowed. Comments against an individual that violate the principles of the right to honor, to personal and family privacy and to one's own image shall not be allowed either.  Catalonia Hotels & Resorts shall not be held responsible for any damage caused by the comments made by the participants in the Promotion, which may at any time offend the sensibilities of other participants.

7.- DISCLAIMER OF LIABILITY

By way of example, but without limitation, Catalonia Hotels & Resorts accepts no responsibility for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor for the use made by the participant with regard to the prize obtained from this Promotion. Catalonia Hotels & Resorts assumes no responsibility whatsoever for any damage or harm of any kind that the participants, winner or third parties may suffer.

Catalonia Hotels & Resorts assumes no responsibility in cases of force majeure or fortuitous event that may prevent the Promotion from taking place or the total or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to fraud detected in the same, technical errors, or any other reason that is not under the control of Catalonia Hotels & Resorts and that affects the normal development of the Promotion, Catalonia Hotels & Resorts reserves the right to cancel, modify or suspend the same.

8.- SOCIAL NETWORKS AND PROMOTERS

The Promotion is not sponsored, endorsed, administered or associated in any way with any social network (Facebook, Instagram, Twitter, etc.), or suppliers (40 Challenge, etc.); therefore, participants release the social networks and suppliers from any liability for any damages arising from the same.

9.- PROTECTION OF PERSONAL DATA

The company responsible for the processing of the participants' data is Duques de Bergara S.L.U (Catalonia Hotels & Resorts), with address at Bergara 11, 08002 Barcelona and identification number B-58227877.

Catalonia Hotels & Resorts takes the protection of privacy and personal data very seriously. Therefore, participants' personal information is kept securely and treated with the utmost care.

In accordance with the provisions of the applicable regulations on data protection, and specifically in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, each participant, with the acceptance of these Bases consents that the personal data provided for participation in this Promotion are incorporated into a file owned by Duques de Bergara S. L.U. for the purposes of carrying out the Promotion, delivery of the prize, publication and dissemination of the winner for promotional purposes in the media and to ensure compliance with the provisions of these rules.

The participants guarantee that the personal data provided are truthful and are responsible for notifying Catalonia Hotels & Resorts of any modification thereof. Catalonia Hotels & Resorts reserves the right to exclude from this Promotion any participant who has provided false information. Catalonia Hotels & Resorts cannot be held responsible for any unlawful theft, modification or loss of data.

Participants have the right to (i) access their personal data, as well as (ii) request the rectification of inaccurate data or, where appropriate, request its deletion, (iii) request the limitation of the processing of their data, (iv) oppose the processing of their data and (v) request its portability. Participants may exercise all these rights at the following email address dpo@cataloniahotels.com indicating the reason for their request.

The participant will have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in the event that he/she considers that the processing of his/her personal data is not in compliance with the regulations, as well as in the event that he/she is not satisfied with the exercise of his/her rights.

10.- ACCEPTANCE OF THE TERMS AND CONDITIONS:

Catalonia Hotels & Resorts may at its discretion: (i) modify these terms and conditions, (ii) modify the start and end dates of the Promotion, (iii) replace the prize with another of a similar category, or (iv) cancel the promotion at any time, all of which will be duly communicated to the participants. Catalonia Hotels & Resorts asks all participants to respect these terms and conditions and to participate in good faith in order to guarantee a fair and correct operation of the Promotion.

11.- APPLICABLE LAW AND JURISDICTION

These legal bases shall be governed in accordance with Spanish law. The Courts and Tribunals of the city of Barcelona will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfillment of these rules.
