Condiciones generales de contratación

The aim of this document is to regulate the General Terms and Conditions for using the online booking services of accommodation of Promotora Kasde S.A., (hereinafter referred to as "Catalonia Hotels & Resorts") a Spanish company with registered address at C/Castellnou 61, 08017 Barcelona, with telephone number 932360000, tax identification number A-08405490 and which is registered on the Companies Registry of Barcelona, in volume 2765, section 2, folio 229, sheet number 29428, 1st entry.  

The terms "you" and "user" are used her to refer to all those individuals who for any reason whatsoever access www.cataloniahotels.com (hereinafter, the website) or who use the services provided on the portal. The use of these services shall imply the full and unreserved acceptance and validity of all of the General Terms and Conditions. As a customer, you hereby state that you are of age and have sufficient legal capacity to be bound by these General Terms and Conditions when you contract services from Catalonia Hotels & Resorts.  

Catalonia Hotels & Resorts hereby informs you that the procedures for obtaining the services offered are those described herein, in addition to any specific terms and conditions displayed on screen while you are browsing, so that you are able to state that you are aware and accept such procedures as a requisite to contracting the services offered on the website. 

The online booking services of accommodation are intended to be used for booking rooms at any of Catalonia Hotels & Resorts's hotels. The use of these services shall imply the full and unreserved acceptance and validity of all of these general terms and conditions as well as any specific terms and conditions consented to for the stay selected by the user. 

After having made an online booking, the user shall receive a confirmation email with a booking reference number. This email shall serve as proof of your booking and confirmation of its acceptance of the general and specific conditions.  

Furthermore, the user may choose to receive an email so that she/he can check in online and thus speed up the check-in process when she/he arrives at the hotel. 

The user undertakes to use the services in compliance with law and order, moral standards and proper conduct, in addition to with the provisions in these General Terms and Conditions. Therefore, you undertake not to use the services for unlawful purposes and/or in breach of the provisions set out herein, or that are harmful to the rights and/or interests of third parties, or that could cause damage to the services and/or image of Catalonia Hotels & Resorts in any way whatsoever. 

For the greater convenience and benefit of users, Catalonia Hotels & Resorts may, at any time and without prior warning, unilaterally modify the online accommodation booking services provided or the operating and technical terms and conditions of use of the services. 

The online accommodation booking form will contain the details or the specific terms and conditions for the stay booked by the user: hotel, check-in and check-out dates, meal plan, extra bed charges and the cancellation policy, amongst others.    

When a search is made, the prices will be given per room per night. However, the total price of the stay booked once VAT, other indirect taxes and the tourist tax have been charged will be given on an individual basis on the booking form. 

Bookings made through this website shall be covered by warranty through the credit card provided by the user on the form. Failure to check in or cancellations made outside the deadline (less than 24 hours) shall be automatically debited from the credit card used in the amount charged for one night, plus cancellation fees.  

To cancel a booking, you can call our booking call center on 932360059 from Mondays to Fridays from 8:30 a.m. to 8 p.m., and on Saturdays and Sundays from 10 a.m. to 2 p.m. and 4 p.m. to 8 p.m. Please call your hotel destination directly outside of our office hours.  

Catalonia Hotels & Resorts reserves the right to unilaterally modify any of the points provided for herein without prior warning in the manner it deems fit. 

In the event of a mistake in the price posted, Catalonia Hotels & Resorts reserves the right to modify the reservation price and is exempt from any responsibility for such modification, only in the event that it has published an erroneous price produced by a technical and/or human error and provided that the error is accredited to the client. 

Should any of the clauses in these terms and conditions be declared void or unenforceable, the rest of the general terms and conditions shall remain as set forth herein. None of the clauses in this agreement shall in any way affect the inalienable rights of consumers. If you are not a consumer, you expressly waive your right to withdrawal. 

Theses General Terms and Conditions are subject to Spanish law and any disputes that may arise from them shall be resolved before the Courts and tribunals of the city of Barcelona, Spain, which shall have sole and exclusive powers over any other jurisdiction whatsoever. The foregoing shall be without prejudice to the powers of the Courts and Tribunals of the domicile of consumers should they have consumer and user status as provided for in Act 1/2007, which passed the amended text of the Consumer Protection Act, as well as any other additional laws or regulations in force that may substitute it at any given time.
